Terms of supply
These terms apply to quotations issued by Mallikarjuna Stones Ltd (UK company number 17314931) and to orders we accept for Shahabad limestone supplied direct from our quarry and polishing yard in Karnataka, India, for delivery worldwide. They are business-to-business terms; consumer rights do not apply. Where a signed supply agreement exists between us and you, that agreement takes precedence over these terms.
1. Quotations and orders
Quotations are given for the stone, finish and quantity stated. A quotation is an invitation to order, not an offer capable of acceptance; a contract forms when we confirm your purchase order in writing. Prices exclude VAT, duty and any local taxes that apply at destination, unless we say otherwise in writing. We can quote to your nearest port or delivered to your yard, on request.
2. Payment
Our standard payment terms are a 50% deposit on order confirmation and the balance before shipping documents are released. These terms may be varied by agreement in the quotation. Late payment attracts interest under the Late Payment of Commercial Debts (Interest) Act 1998. Title in the stone passes on full payment.
3. Samples, and what they represent
Samples show the range of the bed at the time they were cut. They are indicative of colour, texture, fossil content and finish; they are not a guarantee that every piece in a consignment will match them. Where uniformity matters, discuss a range-selected batch with us before ordering.
4. Natural variation
Limestone is a sedimentary material. Colour banding, shell and fossil detail, tonal drift between beds, and minor surface pitting are inherent characteristics and are not defects. We will discuss banding preference on request, and will say so plainly where the bed does not allow it.
5. Tolerances and technical data
Dimensional and thickness tolerances are confirmed against the specification agreed with each order. Technical data for the stone ordered is available on request from [email protected].
6. Packing
Stone is supplied packed and marked to the packing list, in ISPM-15 treated timber crates with individual slabs edge-protected and separated. Packing materials are consumables and are not returnable. Crate and pallet weights are stated on the packing list; you are responsible for confirming site access and lifting capacity before delivery.
7. Delivery
We export worldwide. Production and transit times quoted are working estimates. Delivery dates are not of the essence, and we are not liable for delay caused by port congestion, vessel re-routing, customs inspection or any other event beyond our reasonable control. Part-shipment of a multi-container order is permitted.
8. Inspection and claims
- Note visible transit damage on the delivery paperwork before signing.
- Notify shortage or transit damage within 7 working days of delivery, with photographs and the packing list.
- Notify claims of non-conformity within 30 days of delivery and before fixing. Once stone is cut, laid or fixed it is deemed accepted.
- Do not dispose of, resell or process material subject to a claim until we have had a reasonable opportunity to inspect it.
Where a claim is upheld our liability is limited, at our option, to replacement of the non-conforming material or credit of its invoice value. We do not accept liability for installation, removal, access, consequential or economic loss. Nothing in these terms limits liability for death, personal injury or fraud.
9. Storage and handling
Store material on level, drained ground and keep slabs off soil. Limestone stains: do not use acidic cleaners, and protect faces from cement, grout and metal swarf during construction. Damage arising from site handling or unsuitable cleaning is excluded.
10. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction. Where the buyer or the goods are located in India, we may also seek to enforce our rights in the courts of India. That does not change the governing law: English law continues to apply.
